TGS Baltic Associate Partner Karolis Smaliukas and TGS Baltic Public Procurement practice team successfully represented a client in one of the first judicial disputes in Lithuania regarding the practical application of the supplier ‘self-cleaning’ doctrine.
Case law on the application of the ‘self-cleaning’ doctrine is developing both in Lithuania and throughout the European Union, given that the possibilities of suppliers to ‘self-clean’ were consolidated only in the 2014 Public Procurement Directives of the European Union.
The experience acquired contributing to the creation of relevant case law will allow helping clients (suppliers, contractors) to implement the rehabilitation option provided for in the Law on Public Procurement in practice, as well as advising contracting authorities on practical aspects of assessing the ‘self-cleaning’ of suppliers.
